Terms and Conditions

These Terms and Conditions (“Terms”) are an agreement between you and Superwize Consulting (“Superwize”, “we”, “us”, or “our”). By accessing or using superwizeconsulting.com (the “Site”), subscribing to our newsletter, or engaging our services, you accept these Terms. If you do not agree with any part of these Terms, please do not use the Site.

If you use the Site or engage our services on behalf of a company or other organisation, you confirm you have authority to bind that organisation, and “you” includes that organisation.

Superwize Consulting provides business process outsourcing (BPO), offshore team-building, recruitment support, and related consulting services, primarily across Nepal and Australia (the “Services”). Descriptions of Services on the Site are general in nature; the specific scope, deliverables, and terms of any engagement will be set out in a separate proposal, statement of work, or service agreement (“Service Agreement”). If there is any inconsistency between these Terms and a signed Service Agreement, the Service Agreement prevails for that engagement.

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in any way that breaches applicable laws or regulations;
• Attempt to gain unauthorised access to the Site, its servers, or connected systems;
• Introduce viruses, malware, or other harmful code;
• Scrape, copy, or republish Site content for commercial purposes without our written permission;
• Submit false, misleading, or fraudulent information through our forms; or
• Use the Site to send spam or unsolicited communications.

Any enquiry submitted through the Site is a request for information only and does not create a binding engagement. An engagement commences only when both parties sign a Service Agreement or we otherwise confirm acceptance in writing.

You agree to provide accurate, complete, and timely information reasonably required for us to deliver the Services, and you acknowledge that delays or inaccuracies in that information may affect timelines and outcomes.

• Quotes and pricing displayed or provided are indicative only unless confirmed in a Service Agreement, and are exclusive of applicable taxes unless stated otherwise.
• Fees, invoicing schedules, and payment terms for engagements are set out in the relevant Service Agreement.
• Unless otherwise agreed, invoices are payable within the period stated on the invoice, and we may suspend Services for overdue accounts after reasonable notice.

All content on the Site — including text, graphics, logos, the Superwize name and branding, and page design — is owned by or licensed to Superwize Consulting and is protected by intellectual property laws. You may view, download, and print pages for your personal or internal business use, but you must not otherwise reproduce, modify, or distribute Site content without our prior written consent.

Ownership of materials created under a specific engagement is governed by the relevant Service Agreement.

Each party agrees to keep confidential any non-public business information disclosed by the other party in connection with an enquiry or engagement, and to use it only for the purpose for which it was disclosed. This obligation does not apply to information that is publicly available, already lawfully known, or required to be disclosed by law.

The Site may contain links to third-party websites, including our social media pages. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of third-party sites, and a link does not imply our endorsement.

The Site and its content are provided on an “as is” and “as available” basis. While we take care to keep information accurate and up to date, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete, current, or suitable for your specific circumstances.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right you may have under the Australian Consumer Law or other laws that cannot lawfully be excluded.

To the maximum extent permitted by law, Superwize Consulting will not be liable for any indirect, incidental, special, or consequential loss — including loss of profits, revenue, data, or business opportunity — arising out of or in connection with your use of the Site.

Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied. Liability in connection with a specific engagement is governed by the relevant Service Agreement.

You agree to indemnify Superwize Consulting against claims, losses, and expenses (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Site, except to the extent caused by our own negligence or wrongful act.

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms. Termination of engagements is governed by the relevant Service Agreement. Clauses relating to intellectual property, confidentiality, liability, and indemnity survive termination.

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia. Where an engagement is performed in Nepal and the parties agree in a Service Agreement, the laws specified in that agreement will apply to that engagement.

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date, and your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
